These Terms of Service ("Terms") are a legal agreement between you and Amit Nivedan Kalra ("we," "our," "us"), the developer of AUM ("the App"). By downloading, installing, or using AUM, you agree to be bound by these Terms. If you don't agree, please don't use the App.

1. Acceptance of terms

By using AUM you confirm you're at least 13 years old (or the minimum age of digital consent in your jurisdiction) and agree to comply with these Terms and with Apple's App Store terms.

2. License grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use AUM on Apple devices you own or control, for your personal, non-commercial use, subject to these Terms and to Apple's Licensed Application End User License Agreement, which these Terms supplement. In the event of a conflict between these Terms and Apple's standard EULA, Apple's EULA governs with respect to Apple's minimum required terms.

This license does not permit you to:

  • Copy, modify, or create derivative works of the App
  • Reverse-engineer, decompile, or disassemble the App
  • Rent, lease, lend, sell, redistribute, or sublicense the App
  • Remove or alter any proprietary notices in the App
  • Use the App for any unlawful purpose

3. What AUM does

AUM plays solfeggio-frequency tones and binaural beats, and lets you layer your own imported audio ("subliminals") underneath audio already playing in other apps on your device (such as Spotify, Apple Music, YouTube, or podcast apps). AUM does not control, own, or distribute the audio playing in those other apps — it layers its own output alongside it. AUM also includes an optional song-recognition feature (via Apple's ShazamKit) and an on-device "Ask AUM" recommendation feature (via Apple Intelligence, where supported).

4. Health & wellness disclaimer — please actually read this

This is the most important section. We want to be straightforward with you, not sell you something we can't back up.

  • AUM is not a medical device, is not intended to diagnose, treat, cure, or prevent any disease or medical condition, and is not a substitute for professional medical or mental health advice, diagnosis, or treatment.
  • Solfeggio frequencies and the 432 Hz tuning tradition are long-standing beliefs and musical traditions, not claims backed by controlled clinical trials. Binaural beats are a genuine, documented auditory phenomenon, but research on their effect on mood, focus, or sleep is mixed. Subliminal audio's most well-supported mechanism is the illusory truth effect (repetition making a statement feel more familiar/true over time) — not hidden mind control. We describe these features honestly as traditions and beliefs worth testing for yourself, not as proven science, both in the App and on our website.
  • If you have a medical condition — including epilepsy, a heart condition, tinnitus, hearing sensitivity, or a mental health condition — talk to a qualified healthcare provider before using audio-based wellness tools, and stop use immediately if you experience discomfort.
  • Listen at a safe, reasonable volume. Extended listening at high volume, especially through headphones, can damage your hearing regardless of what's playing.
  • Don't use AUM, including CarPlay or Lock Screen controls, in a way that distracts you from driving safely or operating machinery.
  • You use AUM's frequency, binaural beat, and subliminal features entirely at your own discretion and risk.

5. Third-party content & services

AUM is designed to run alongside other apps (Spotify, Apple Music, YouTube, podcast apps, etc.). We have no control over and no responsibility for the content, availability, or behavior of those third-party apps. Song matches returned by the song-recognition feature come from Apple's Shazam catalog via ShazamKit and are subject to Apple's own terms.

6. Your imported content

You retain full ownership of any audio you import into AUM (songs, voice recordings, affirmation tracks). That content is stored locally on your device — we never receive, host, or have access to it. You're responsible for having the necessary rights to any content you import and for complying with copyright law when doing so.

7. Subscriptions & purchases ("Aum Pro")

AUM offers an optional "Aum Pro" subscription that unlocks additional features. The following applies to all purchases, processed entirely through Apple's App Store:

  • Pricing: displayed in your local currency through the App Store and may change with notice; existing subscribers are notified before any renewal at a new price, per Apple's requirements.
  • Auto-renewal: subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours prior to the period's end.
  • Managing or cancelling: done entirely through your Apple ID account settings (Settings → your name → Subscriptions), not within AUM.
  • Free trials: if offered, automatically convert to a paid subscription unless cancelled before the trial ends. Trial eligibility is determined by Apple.
  • Refunds: all purchases are billed by Apple. Refund requests must go through Apple at reportaproblem.apple.com — we're not able to process refunds directly.
  • Restoring purchases: you can restore a previous purchase from the same Apple ID at any time from AUM's settings.

8. Acceptable use

You agree not to use AUM to:

  • Violate any applicable law or the rights of any third party
  • Import or distribute content you don't have the rights to use
  • Attempt to disrupt, reverse-engineer, or compromise the App or its services
  • Circumvent the subscription or payment system

9. Intellectual property

AUM, including its design, code, features, presets, and branding, is owned by Amit Nivedan Kalra and protected by applicable copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any of that ownership to you.

10. Disclaimer of warranties

AUM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY WELLNESS OR SUBJECTIVE OUTCOME WILL RESULT FROM USING IT.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF AUM, INCLUDING ANY HEALTH-RELATED OUTCOME. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR AUM IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $50 USD.

12. Termination

We may suspend or discontinue AUM, or your access to specific features, at any time. You can stop using AUM at any time simply by deleting the App; if you have an active subscription, remember to cancel it separately through your Apple ID settings, since deleting the App does not cancel a subscription.

13. Governing law

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles, except where local consumer-protection law in your country of residence provides otherwise.

14. Changes to these terms

We may update these Terms as AUM changes. We'll update the effective date above when we do, and significant changes will be noted in the App's release notes. Continued use of AUM after an update means you accept the revised Terms.
